Purpose
These terms of use (the "Terms") govern access to and use of the Blitz Shopping service, whether that use is free or paid.
The sale of a subscription is governed by separate terms, the terms of sale, which apply alongside these Terms. Where the two documents conflict on a matter concerning the sale, the terms of sale prevail.
Publisher
Blitz Shopping is published by the company identified at the head of this document, referred to as "the publisher".

Acceptance
Using Blitz Shopping constitutes full acceptance of the Terms in force. Anyone who does not accept them must stop using the service, and may remove it from their conversations at any time.
Access to the service
Blitz Shopping is used inside the Telegram application. A valid Telegram account, a compatible device and internet access are therefore required. These come from the User and from third parties, and their cost remains the User's.
The service is open to persons aged fifteen or over. Any paid order additionally requires legal capacity to contract.
There is no sign-up, no password and no account to create: the User's Telegram identifier is enough to recognise them.
What the service does
The User sends an item into a conversation and the item is on the list. They tap the item and it is crossed off. A list may be personal, or shared with the members of a group conversation.
The service is a convenience tool. It is not a medical device, a professional tool, or a backup or archiving service. Users should not entrust it with information whose loss would harm them.
Free of charge, free period and capping
Blitz Shopping is free to start and stays free for as long as it has not become part of the User's routine. The arrangement is stated in the first message: the service is free for a generous period, then paid.
It works as follows:
- Open use. While use stays occasional, the service works in full and nothing is asked.
- The ask. Once use becomes regular, the User receives one message explaining what follows. That message starts the free period and states its dated end.
- Free period. It lasts 6 months from that message. The service works without restriction throughout. Reminders may be sent, at most once a month, and never to an inactive User.
- Capping. At the end of the free period, absent a subscription, the User keeps their list and can carry on crossing items off. Adding new items and household sharing are suspended until they subscribe.
The length of the free period and the other parameters announced to a User are acquired by them as announced. A later change applies only to Users arriving after it.
Household sharing is a paid feature from its first use and does not benefit from the free period described above.
No data is deleted as a result of capping or of a subscription expiring.
User content
The User remains the owner of the content they put on their lists, and warrants that it is lawful.
They grant the publisher, for only as long as is needed to supply the service, the right to store and display that content to themselves and, for a shared list, to the members of the conversation concerned. This permission is strictly limited to operating the service.
The publisher does not exploit that content for anything else. It does not sell it, rent it, pass it to any third party for commercial purposes, or use it for advertising or to train an artificial intelligence system.
In a group conversation, the User is informed that what they write is visible to every member of that conversation.
Acceptable use
The User undertakes not to:
- use the service for any unlawful purpose or contrary to public order;
- enter content that is abusive, defamatory, hateful, or infringes the rights of a third party;
- automate their exchanges with the service, submit an abnormal volume, or seek to test, circumvent or defeat its limits;
- attempt unauthorised access to the service, its source code or the infrastructure serving it;
- resell, sub-license or commercially exploit the service;
- use household sharing to open access to a set of people manifestly exceeding the domestic use it is intended for.
Availability
The publisher endeavours to keep the service available but is under no obligation of result. No service level is guaranteed. Access may be interrupted, suspended or limited, in particular for maintenance, updates, technical incidents, or through the act of a third party.
The service depends on the Telegram application, published by a third party independent of the publisher. Unavailability, alteration or discontinuation of Telegram is outside the publisher's control.
Where a prolonged interruption affects a running subscription, the consequences are governed by the terms of sale.
Changes to the service
The publisher may develop the service, and add or remove features. It will not remove a feature forming part of what was sold to a subscribed User without offering a pro-rata refund.
Personal data
The publisher is the controller within the meaning of Regulation (EU) 2016/679 ("GDPR").
What is collected
The service works with no name, no email address, no telephone number and no postal address. What is recorded is:
| Data | Why |
|---|---|
| The User's numeric Telegram identifier | to recognise the person and attach their subscription |
| The numeric identifier of the conversation | to attach a list to the conversation it lives in |
| The language declared by Telegram | to reply in the User's language |
| The text of items and the names of lists | this is the service itself |
| Usage timestamps | to measure how regular use is, and trigger the ask and reminders |
| The parameters announced to the User | to prove what was promised if it is ever disputed |
| Subscription start and end dates, and a customer reference from the payment provider | to run the subscription |
Neither card numbers, nor bank details, nor IP addresses are recorded. Payment data is processed by the provider named in the terms of sale, under its own responsibility.
Legal bases
Performance of the contract, for keeping the lists and the subscription; the publisher's legitimate interest in measuring aggregate usage and securing the service; legal obligation for the retention of accounting records.
Recipients
Data is passed to no third party for commercial purposes. Acting technically on the publisher's behalf only: the server's host, and the payment provider for the payment operation alone.
Retention
List and usage data is kept for as long as the User uses the service, and erased on request. Accounting records relating to a payment are kept for ten years, under article L. 123-22 of the French Commercial Code.
The User's rights
The User has the right of access, rectification, erasure, restriction, objection and data portability. These rights are exercised at [contact_email], stating the Telegram identifier concerned so that the request can be matched.
Erasing a shared list does not erase the contributions of the other members of that conversation.
The User may lodge a complaint with the French data protection authority, the CNIL — cnil.fr.
Transfers outside the European Union
The publisher arranges no transfer of data outside the European Union. The Telegram application and the payment provider carry out their own processing, governed by their own policies, over which the publisher has no control.
Cookies
The service does not run in a browser and sets no cookies. The provider's payment page is governed by its own policy.
Intellectual property
The service, its name, its source code, its interface and its texts remain the exclusive property of the publisher. The Terms grant the User only a personal, non-exclusive, non-transferable right of use, for as long as they use it.
Suspension and termination
By the User. The User stops using the service whenever they wish, by removing Blitz Shopping from their conversations. No formality is required. For a subscriber, the financial consequences are governed by the terms of sale.
By the publisher. Where the Terms are breached, the publisher may suspend access and then end it, after a formal notice left unremedied for eight days, save in cases of urgency or manifest seriousness. The consequences for a subscribed User are governed by the terms of sale.
Liability
The publisher is liable as of right for the proper performance of the contract towards a User who is a consumer, under and subject to article L. 221-15 of the French Consumer Code.
It is not answerable for the consequences of Telegram being unavailable, of use of the service that does not comply with the Terms, or of the loss of content the User ought to have kept elsewhere.
Nothing in these Terms limits the publisher's liability for personal injury, gross negligence or wilful misconduct, or removes rights the User holds under mandatory consumer law.
Complaints and mediation
Any complaint should be sent to [contact_email]. How to complain and how to use a consumer mediator are set out in the terms of sale.
Changes to the Terms
The publisher may change the Terms. The applicable version is the one in force on the date of use; its effective date appears at the head of this document. A substantial change is brought to Users' attention through Telegram.
Parameters already announced to a User remain acquired by them, as set out in the article on the free period.
Governing law and jurisdiction
The Terms are governed by French law.
A User who is a consumer keeps the benefit of the mandatory provisions of the law of their habitual residence within the European Union, under article 6 of Regulation (EC) No 593/2008.
Failing an amicable settlement, any dispute falls to the courts having jurisdiction under the ordinary rules, a User who is a consumer being free to choose the court of the place where they lived when the contract was formed or when the harmful event occurred.
