Purpose and scope
These terms of sale (the "Terms of Sale") govern the sale of a subscription to the Blitz Shopping service by the company identified in Article 2 (the "Seller") to any natural person acting for purposes outside their trade, business, craft or profession (the "Customer").
They apply to the exclusion of any other terms. The Customer confirms having read and accepted them before ordering. The applicable version is the one in force on the order date; its effective date appears at the head of this document.
Use of the service, whether free or paid, is further governed by the terms of use, which apply alongside these Terms of Sale.
Who the Seller is
Blitz Shopping is sold by the company identified at the head of this document, referred to as "the Seller".

What is sold
Blitz Shopping is a digital service delivered inside the Telegram messaging application. It keeps a shopping list: the Customer sends an item as a message and the item is on the list; they tap the item and it is crossed off.
The service requires no software other than Telegram, and is supplied on no physical medium.
What the subscription includes
For the term defined in Article 8, the subscription gives the Customer:
- use of their own list, with no cap on the number of items or on how long it is used;
- household sharing — any Telegram group conversation the Customer belongs to is covered by their subscription, with no limit on the number of groups or of participants. Other members of a covered group use the service without subscribing themselves.
There is a single plan. There are no tiers, no add-ons and no surcharges.
What the subscription does not include
The subscription does not include internet access, the Customer's device, or a Telegram account. These are supplied by third parties and remain at the Customer's expense.
Price
The subscription price is €12 including all taxes for the term defined in Article 8.
The price is inclusive of French value added tax applicable on the order date. No set-up, administrative or delivery charge is added.
The applicable price is the one displayed at the time of the order. The Seller may change its price at any time; a change has no effect on a subscription already paid for, which runs to its term at the price paid.
Ordering and formation of the contract
Orders are placed online, as follows:
- the Customer opens the payment link from Blitz Shopping;
- they are taken to the secure payment page of the provider named in Article 6, which summarises the service ordered and its price;
- they enter their payment details and confirm the order;
- confirming the order constitutes acceptance of the price and of these Terms of Sale, and carries an obligation to pay.
The contract is formed when payment is actually received. The Seller then confirms the subscription and its end date to the Customer through Telegram.
Payment
Payment is made once, in full, at the time of the order, by payment card and by the other means offered on the payment page.
Payments are processed by Stripe Payments Europe, Limited, a payment service provider. The Seller never has access to the Customer's card number, which does not pass through and is never stored on the Seller's systems.
The service is not activated until payment is received. A payment that is declined, incomplete or later reversed confers no right of access.
No recurring debit is set up. The Seller holds no payment mandate and cannot charge the Customer at the end of the term or at any other time.
Supply of the service
As a digital service, there is no shipment, no physical delivery and no carriage charge.
The subscription is activated immediately after payment is received, automatically. The Customer is notified in Telegram. Should a technical incident delay activation, it will occur within twenty-four hours at the latest; failing that, the Customer may obtain a full refund on request to the address in Article 2.
Term, expiry and renewal
The subscription is entered into for a term of one year from activation.
The subscription does not renew automatically. It ends at its term as of right, with no formality, no notice to give and nothing further to pay. There is nothing for the Customer to cancel.
To continue, the Customer makes a new payment by the same means as the first. The Seller sends a reminder before the term ends. A payment made before the term extends the running subscription and never shortens it; a payment made after the term opens a new period running from that payment.
On expiry, the Customer has a 14-day grace period during which the service continues to work unchanged. This period is acquired by the Customer as announced at the time of payment; a later reduction of its length has no effect on a subscription already taken out.
After that, the Customer keeps access to their list and can carry on crossing items off; adding new items and household sharing are suspended until a new payment. No data is deleted as a result of expiry.
Right of withdrawal
The Customer has fourteen days from the formation of the contract to withdraw, without giving reasons and without cost, under articles L. 221-18 et seq. of the French Consumer Code.
The Seller does not ask the Customer to waive this right. The service is supplied immediately for the Customer's convenience, and that early performance neither diminishes the right to withdraw nor gives rise to any deduction for the period used.
To withdraw, the Customer sends an unambiguous statement of that decision to [contact_email]. They may use the model form appended to these Terms of Sale, but are not required to.
The Seller acknowledges the withdrawal without delay and refunds all sums paid within fourteen days at the latest of being informed of the decision, using the same means of payment as the order, at no cost to the Customer.
Access to the service ends on the date of withdrawal.
Refunds and credit notes
Any refund — whether following a withdrawal, a legal guarantee or a goodwill gesture — gives rise to a credit note issued by the Seller amending the original invoice.
The credit note carries its own number, references the invoice it amends and states the corresponding value added tax. It is sent to the Customer electronically and kept by the Seller for the statutory period.
Legal guarantees
The Seller is liable for lack of conformity of the digital service under articles L. 224-25-12 et seq. of the French Consumer Code.
Because the service is supplied continuously for the term defined in Article 8, the Seller is liable for any lack of conformity appearing throughout that whole term.
Where the service lacks conformity, the Customer may require it to be brought into conformity. Where that is impossible, takes an unreasonable time or causes the Customer major inconvenience, the Customer may obtain a price reduction or termination of the contract, under articles L. 224-25-16 et seq. of the same code.
The Customer does not have to prove that the defect existed at the time of supply: it is presumed to exist throughout the period of supply.
These guarantees apply irrespective of any commercial warranty. The Seller currently offers no commercial warranty.
Liability
Blitz Shopping is a convenience service for keeping a shopping list. It is not a medical management tool, a professional tool, or a backup system.
The Seller is liable as of right for the proper performance of the contract under article L. 221-15 of the French Consumer Code. It may be relieved of all or part of that liability on proof that non-performance is attributable to the Customer, to the unforeseeable and insurmountable act of a third party unconnected with the contract, or to force majeure.
The Seller is not, however, answerable for the consequences of:
- unavailability, alteration or discontinuation of the Telegram service, whose operation and access conditions are outside the Seller's control (Article 13);
- use of the service that does not comply with the terms of use;
- loss of content the Customer ought to have kept elsewhere.
Nothing in these Terms of Sale limits the Seller's liability for personal injury, gross negligence or wilful misconduct, or removes rights the Customer holds under mandatory consumer law.
Dependence on Telegram
The service runs inside the Telegram application, published by a third party with which the Seller has no shareholding and no agency relationship. Access to Telegram, any cost of it and its own terms of use are matters between the Customer and that publisher.
Should Telegram become lastingly unavailable or change its terms so as to prevent supply of the service, the Seller would inform Customers and refund any running subscription in proportion to the period not supplied.
Personal data
The processing of the Customer's personal data is described in the terms of use, which set out the data collected, its purpose, its legal basis, its retention period and the rights the Customer holds under Regulation (EU) 2016/679 and French Act No. 78-17 of 6 January 1978 as amended.
Payment data is processed by the provider named in Article 6, under its own responsibility and its own policy.
Customer default
Where the Customer breaches the terms of use — in particular through fraudulent, abusive or automated use of the service — the Seller may suspend access and then terminate the subscription, after a formal notice left unremedied for eight days, save in cases of urgency or manifest seriousness.
Where a subscription is terminated for breach, the Seller refunds the portion of the price corresponding to the period not supplied, less any established loss.
Force majeure
Neither party is liable for failure to perform its obligations as a result of force majeure within the meaning of article 1218 of the French Civil Code.
Where the impediment is permanent, the contract is terminated as of right and the Seller refunds the Customer in proportion to the period not supplied.
Complaints and consumer mediation
Complaints. The Customer sends any complaint to [contact_email]. The Seller acknowledges receipt and endeavours to respond within fifteen working days.
Mediation. Under article L. 612-1 of the French Consumer Code, the Customer is entitled to use a consumer mediator free of charge to seek an amicable resolution of a dispute with the Seller. Mediation is available only after a prior written complaint to the Seller has gone unanswered for two months or has not been resolved.

Governing law and jurisdiction
These Terms of Sale are governed by French law.
A Customer acting as a consumer keeps the benefit of the mandatory provisions of the law of their habitual residence within the European Union, under article 6 of Regulation (EC) No 593/2008.
Failing an amicable settlement, the Customer may bring proceedings, at their choice, before the court of the place where they lived when the contract was formed or when the harmful event occurred, or before any court having territorial jurisdiction under the French Code of Civil Procedure.
Severability
If any provision of these Terms of Sale is held void or unenforceable, the remaining provisions continue in full effect, the provision set aside being replaced by a valid provision of equivalent scope.
Changes to these Terms of Sale
The Seller may change these Terms of Sale at any time. The version applicable to a subscription is the one accepted at the time of the order; a later change has no effect on a running subscription unless it is more favourable to the Customer or required by a change in law or regulation.
